I ride my BBS02 for drivetrain longevity, rather than performance or battery life.
You get used to riding a BBS where the motor is happy i.e spinning fast. Sometimes that requires a period of 'ghost pedalling'. If you have a throttle fitted, then no need to pedal, but for the motor to be happy...
Don't worry, the BBS series of motors can climb mega steep hills all day, as long as you get the gearing right. Fitting a 42T chainring is a good start. I tend to climb very steep hills with the lowest gear on the cassette and 'ghost pedal', as the cadence is too high for my little legs to keep...

I think you'll find this is just Bafang's way of minimizing warranty claims, rather than complying to any laws. As most of us know, the Chinese like to make their own rules.

Comparing my previous Samsung 29E 11.6Ah 48v battery with my current Samsung 30Q 12Ah 48v battery, I would say that the Samsung 30Q's are far superior to the 29E's.
It's possible, but you'd lose the facility to program the controller with the Bafang software, which is fairly essential IMHO.
Green Bike Kit do a replacement controller with the gear sensor, but you'd have to double check fitment, depending how old your BBS01 is...
Have you tried disconnecting both brake sensor Higo connectors and going for a ride to see if problem persists?
Be careful when riding without brake sensors connected though. Only go for test ride!
Flay me alive for even suggesting this, but you are using branded pads and not some cheapy knock offs?
