I tend to agree. I think the EU will won’t to forget the entire vaccine procurement shambles, it doesn’t look good for them.

The same words appeared in both the U.K. and the EU contracts, so whatever is decided in the court will apply equally to both. It’s just a shame that the EU were so late placing their order and I’m sure AZ made their Best Efforts to help the EU catch up.

UK signed the deal during May 2020, the EU during August. Three months behind. Both contracts have the “best efforts” wording.

What about being very very late placing an order. Does that count as being behind?
