If it's a normal bike possibly converted with one of those aforementioned eBay kits, does that let us off the hook a bit?
she ran out in to the middle of the road dont matter if it was a bike car lorry or sheep end result would be the same, splat ;)

Well not really. A car or bike would be insured.(hopefully)A pedelec /bicycle would not require insurance. An uninsured motorbike rider would be sued for any payments. (ie damages)
If it was found bike fell out of pedelec/bicycle category rider would face prosecution on numerous levels and sued for damages.
Let's say you ran into a kid on towpath. No dongle, no problem legally. But assume you have one fitted you are now riding a motorbike. Uninsured. Kid goes straight to lawyer. Claims damages. Hardluck SW. Prosecution for no tax, CBT, insurance, not registered, no lights, no mot, After prosecution lawyer takes out civil action for damages. Its exactly why I renoved mine. (and to get better range)
Probably a remote chance of happening but how many Ebikes are now in use? It's not if but when. With a dongle you would probably get away with it but with a 1500w label on your kit... No chance. You are on a motorbike.

True but if it was an illegally modified sheep, the shepherd would-be in no end of trouble!!
then the charge will be the same if it was a modded car or motorbike.

she crashed in to the bike so it is her fault at the end of the day.

I live next the railway line and some sheep got on to the line. A high speed train came allong and believe me they did not go SPLAT. Splat sounds like a soft sort of noise but the sheep sounded more like mortor shells going off.

I think the word's needed here are contributory negligence...
That's a different issue. Even in a no fault incident prosecution would be automatic if uninsured etc. Not sure why people think an over powered ebike is any different to an uninsured motorbike. (I, m not saying bike in case mentioned was not legally a pedelec) But how many dongle owners or over powered Ebikes register, tax ,insure and take a CBT?None I, d guess. Its viewed as acceptable but sticking a little petrol engine on bike wouldn't be.. Its actually quite odd.
It will change as Zero motorbikes sell more.

The Red Ditch
A pedestrian who was knocked down by a cyclist in a suspected hit-and-run last month has died.

Duncan Dollimore, head of campaigns at national charity Cycling UK, said the statistics showed people who use electric and conventional bikes "present a minimal danger to others".

"Given the limitations and current laws governing e-bikes, Cycling UK does not believe there is any reason to suggest their use poses any greater risk to the public than a normal pedal cycle," he said.

Well, I am in a similar boat and dont expect people who dont know me to be upset on my behalf, in fact the situation is just the oposite as I would prefer normality cos as the saying goes life goes on. Whislt I dont consider I have been disrespectful I doubt the family will be bothered trawling through this site, and Iif they did they would see that most of the posters concerns are about how this may impact them.
