Same news but not behind a paywall: "Dylan's mother had spotted her son stray on to a nearby pedestrian footpath, which serves as a cut-through to the town centre, moments before the collision." Police had initially decided not to press charges. It's clearly inappropriate to speculate, but last time I checked there is no legal requirement to have bike insurance or a helmet for an EAPC. I've been there myself, two-year olds can move very quickly and you have to be constantly on your guard, but rather than count her blessings she's pressed the police to prosecute? https://www.aol.co.uk/news/woman-65-charged-over-e-163728060.html

They have these shared cycle paths in German cities. If you, as a pedestrian, mistakenly put one foot on the wrong side of the line, some German will grab your arm and drag you back onto the right side of the line. Like the illegal ebikes, the rules are adequate and clear. The only thing missing is the enforcement by all parties.

It's clearly inappropriate to speculate, but last time I checked there is no legal requirement to have bike insurance or a helmet for an EAPC.
The charges the police have preferred clearly indicate that in their view it wasn't a legal EAPC and was therefore automatically a motorcycle.

Not unusual these days, a high proportion of e-bikes in use breach the EAPC rules, their riders at risk of a number of potential charges just for using them on the roads, however safely.
