The real reason was quite simple
"The commission subsequently announced that it had considered the allegations but would not be launching an investigation because it did not have sufficient evidence..

her backup strategy is to accept what parliament may come up with. That would suit both TM and JC as both can claim a degree of victory.
Parliament would go for either customs union or TM deal + confirmatory vote.
The best way out is a 3 question confirmatory vote. 3 choices: WTO, TM deal, remain. Voters can tick one or two boxes out of of 3.

It sounds like throwing in the towel but I suspect that TM is up to some trickery.
As the withdrawal agreement cannot be opened how can the CU and SM be legally attached. What stops the ERG kicking out these deals from the political declaration once the WA has been approved?
She says that she will make any indicative votes legally binding but what will be the motions in those votes?
