Isn't legality covered by what is written on the motor? If it says 250w 48v on motor casing then you should be ok?

I had a thumb lever throttle that did this. Just replace the throttle.

Re the power tailing off, have you played with the programming? Could be the Keep current. I set mine to 100%, as have some other owners.
