That's a worry
first I have heard of this happening and I read German forum regularly...Also in the nicest possible way, Ton is a hefty chap

cant see this happening on a 350 flyer X and they have 5 year warrenty

I have been in retail for 20 years: I do not like what is happening here. 20ston bought a bike, it broke. In law he is entitled to a refund, or if he chooses, to have the bike fixed in a reasonable time. His claim is on the seller, not the manufacturer.

Justebikes sold the bike in good faith. When it failed they returned it to Haibike for repair/replacement. In the meantime they supplied 20ston with a loan bike.

Haibike has presumably got the failed bike, but done nothing about it.

That, at least, is my understanding of the situation.

The correct solution is for Justebikes to refund the money, resume ownership of the failed bike, and take back the loan bike. They in turn should take action against Haibike to get the broken bike replaced. Instead Justebikes tell 20ston that he can sell the loan bike to recoup the money. This is not acceptable and could raise a number of prolems in the future. in particular:

1. Has Justebikes legally transferred ownership of the loan bike to 20ston? Is there a document to this effect? An email saying something like `well, sell it if you can' is not sufficient. Unless 20ston legally owns the bike he cannot sell it.
2. What warranty comes with the bike? Has that been transferred to 20ston, and can he transfer it? Obviously a warranty adds to the value of the bike.
3. What happens if the sale price obtained by 20ston is substantially below the amount he paid to Justebikes? How will he reclaim the difference?
4. Have the twp parties entered into some agreement for full and final settlement, or is this just a chapter of a longer story?

Sorry to be so pedantic, but I do believe that 20ston would be advised to get some legal sdvice (Trading Standards, Citizen's Advice) before he puts the loan bike up for sale. He may think he is putting an end to a sad episode, but it may come back to haunt him.

Justebikes seem to come out of this with little credit. No, they did not cause the fault; yes they did lend 20ston a bike; but at the end of the day, the retailer carries the can for a defective product. They should make the best of a bad job and refund 20ston's money.

Finally, as far as we know,Haibike seem to have done nothing to help either their dealer or the end-user. If this is so, it is worrying that they are expanding their presence in UK throgh Raleigh. If they cannot cope with returns on a small scale, how will they do on a larger one? So far we have not heard a tinkle fom Haibike's bell. Perhaps someone in Raleigh could have a word with their customer services before their reputation is further damaged?

I can understand that. But i worry that if you sell the bike you may still get the hassle. Trading Standards will advise on getting refunds made with security for both parties, or you could appoint a lawyer to hold money and goods in escrow whilst details are sorted out.

Don't want to prolong your agony, so will leave it at that. Goodluck and let us know how you get on.

Billadie spot on. I would bite retailer hand of for a refund...face to face cash exchange under the circumstances, even if it means an excursion

plenty end of season 2012 Haibike on German ebay which accept offers..Hugh got a good deal

even if you go for the Grace which I very much like..you are in the enviable position that you have a spare battery that fits a mulitude of Bosch bikes...well done on the weight!lol

Personally I think setting up a dealer network is the best way to do it as it means you can get local back up although it does mean that prices are higher than direct sellors like Woosh as two groups are taking margins (dealers and distributers). Nothing neccesarily wrong with direct sellng as long as back up is provided but I think you can not beat local support! I believe customer service is key as people will tell more people when they have recieved bad service than when they recieve good service. Key is solving problems quickly when they occassionally occur.

I agree with a lot of what you say Electrifying Cycles, but direct sellers like Woosh, Powerpedals, Cyclezee et al provide somethings a dealer network can't, we know our product, better value for money due to cutting out the middleman and no intermediaries to deal with, the buck stops with us and can't be passed, therefore if there is an issue as in the main topic of this thread, it has to be dealt with quickly to a satisfactory and amicable conclusion or a reputation can be destroyed overnight.

This Forum and the internet in general is a powerful means of keeping everyone in this trade on it's toes, big and small.

I thought that this thread was liable to rear its ugly head again...

at the start of this tread I was trying out, and tempted by an Enduro RC from this supplier, but the bad taste I got when reading this put an end to it...
....its amazing how a thumbs up or thumbs down can influence the undecided decision maker

so on the basis of another thread, where it all ended happily ever after, I put my money with

....although now slowly getting nervous, as the cash is there, but the bike is not yet here, but early next week would probably be a more realistic time scale, as its coming by road from Austria

for any exchange process...on the day of my purchase the rate was 1.24 to the £, but the bank only offered 1.17.......Covent Garden FX were offering nearly 1.23, which is quite a bit better

I'd have no hesitation in doing business with James at Justebikes. If I were unlucky enough to have a bike frame snap during the warranty period, I'd be delighted to exchange the broken bike for a full refund which I'd use against any other machine in stock which I fancy or I'd look around and buy elsewhere.

In my case, any offer of a loan bike would be pointless as I, like many members here, have other bikes. I'm afraid that in the case of member 20ston, what should have been a perfectly simple resolution, the principles of which are enshrined in law, has become a long drawn-out saga culminating in the peculiar arrangement described in recent posts.

The whole imbruglio could have been avoided so easily and I'm sure that James Fitzgerald wishes he had dealt with things differently given the publicity this matter has attracted in these pages. That said, I doubt the episode will harm his business, having sold a great many high-end bikes and having a lengthy list of satisfied customers.

that is a very nice comment on justebikes Indalo, and I am sure that James will be greatful for it....and in the clear light of day, you make perfect sense

for me, the time scale was just unfortunate, and as these sort of purchase decisions are both head and heart, for me, the latter ruled on this occasion...
the Enduro RC was a great ride, and suited me well, but I am sure that 2013 models will be substantially more££s, so I am happy with the savings that I have made, for a very similar spec bike, but upgraded to 2013 kit

Raises the question of what the maximum permitted rider weight is, because they could say it was simply overloaded.
Otoh, some of the rear suspension anchor point designs look really flimsy and stupidly under-engineered, so a good case might be argued that it's really a design fault. After all, any normal MTB or road frame of decent construction and materials would cope with 20 stones.
Hell, mine coped with over 22 stones for several months.
