Dodgy Ebay Listing

It's got a couple of hours to go. So whoever wins this how are they going to play it? Even though the seller is as bent as a five bob note eBay seem happy with it. So It could get into a wrangle about non payment with strikes for the non payer when the seller asks for his money...

He must know he's being jerked around so he might well retaliate by demanding payment.

He can only demand payment if he has the goods - and if he does then we know where jerry's bike has suddenly disappeared to in a few weeks time. It's be one of the fasters cases of found stolen bikes ever!

Please note this is not my bike for sale but someone who has stolen my pics and description.
Jerry would be able to do me a favour please, just to help if I have to have dealings with ebay or the police, would you be able to do a photo or two of the bike with a newspaper or similar, dated within the last few days please? It's just that I think literally a photo says a thousand words (which I then don't have to type out for the benefit of the aforesaid...). I think the police might even be encouraged to take action in the circumstances (although tbh they'd probably require some sort of statement from you, something a bit more definite than a photo). Although I don't know what their priorities are these days.

Yeah I seem to be the lucky party in question lol. I phoned ebay and they promise me that if the other side lodges a claim against me I get to appeal and explain at that point why I'm not paying, I feel fairly reassured that they won't lodge a nonpayment strike.

I've also done an actionfraud report so nobody else need do this

D'oh, I just realised if Jerry knew the pictures and description were his, then in theory he was selling it and potentially might not have it. So in principle the seller might have been authentic, despite lax approach to copyright issues re text and pics, and dodgy appearance engendered by zero feedback.

Mind you Jerry called it "my bike", suggesting he still has possession of it.

Am feeling very confused. Jerry did you list it and then remove it from sale before completion, so that you've still got it?

I don't think you need worry jonathan75 - Jerry did say:
The photos are not from ebay as I have never listed on there. I still own it and have no plans to sell it as I use it every day.

Actually no. He's listing it as £25 postage and he would normally want a bank transfer or Western Union or some way to cover his tracks. But since he knows he's been taken for a walk he could report the buyer for non payment. It would not get anywhere but would entail a lot of eBay hassle.

He's almost certainly a ghost anyway so he's got nothing to lose; and the cops are about as much use as a chocolate dildo in cases like this.

Haha fortunately English contract law is more sensitive to considerations of justice than that (part of its genius).

It has among other things an overriding requirement, that both parties intend to create legal relations, intentions which Jerry here made us think "bad Jerry" didn't have ; intentions which our auction offers were actually intended to prevent being formed, rather than demonstrate :)

Just play along until he asks for money by western union (or whatever the scam is), then you will have all the evidence you need to provide to eBay.

Sorry only just caught up with this. The bike is in mine and in my workshop when I checked last night. It was NOT me selling it, though for 25k I would :)

The fake seller stole my pictures either from here or Flickr.

I would be more than happy to take a picture with newspaper or whatever to prove the seller is fake.
