Accident with a pedestrian on my ebike

I think it's worth a trip to the Citizens Advice Bureau. I just don't like the feeling of walking into something with my pants down.

id not bother with them worse than useless mine are.

the police gather evidence to submit to the cps if they have enough that is to get a prosecution.

as they dont have the bike they have nothing other than it was just a normal bike crash.

as it was a week ago they been round b4 now to get it and caution you at the same time.

but you could off taken the bike to bits buy now sold it or thrown the motor in the canal or buried it some where.

you could also have made it even faster with a 1000w motor but then its not the same bike involved in the crash.

also did they breath test you?

The last time i went to the CAB they didn't even know about the regs and clauses i was quoting. But still worth a trip. Even if it's so I feel like i'm doing something.

Again. All valid points soundwave. No breath test. Just had a look at the ambulance report form and no mention why i wasn't breathalysed.

It may be time to hang up my cycling shoes. Atleast pedestrians can hear a 50cc scooter coming down the road :(

game over forget about it judge would throw it out of court as not enough proof and police not doing there job on the site of a RTA.

cps would not even bother anyway as no way to get a conviction.

only option law wise is if she tried to sue you and as police has no proof seized from the seen she got no chance ;)

Now that is some setup. I'd feel like I was competing in the Redbull City Downhill Championship every time i left the house. Not sure what everyone would make of seeing me cruising around looking like that.

Speaking of have you seen the GoPro video Combing Valparaiso's Hills on YouTube.

I just let out the biggest sigh of relief. I know it's not over till it's over, but what you said makes sense. I'm no legal expert (which is why out of desperation I posted my problem on a public forum).

Perhaps i'll sleep a little better tonight than i have done since the accident.

Massive thank you to all of you for taking the time to comment. Your advice is appreciated and helped me immensely. Just like chatting with mates at the pub.

9month old has a temperature :( just given him some Calpol

I've always wanted to shoot one of these pictures. Make it look like it was just after the accident. There was an old BMW 5 series near us. With half stuck in a tree and the rest embedded in the embankment. God knows how the driver got out, the steering wheel was up against the driver's headrest.

Cwah. I wish the Police dealt with me that way. Unfortunately while i was in the ambulance the Police had enough time to check my bike out. The policeman was quite nice and noticed I had hydraulic brakes.

It seems crazy the circumstances of your collision were much worse than mine and yet i am being investigated.
From watching too much daytime tv... if the police suspect a vehicle is not insured or fully legal the would impound it on the spot....
If they had any suspicion that you were riding an illegal vehicle you wouldn't be allowed to take it away.

Thanks paul20v. I wish I'd copied the video files from my action camera from the day before. This is precisely why I bought the bloody thing in the first place, to cover my arse in situations like this.

It's unfortunate, but in the eyes of the law I am guilty until proven innocent. I will seek legal representation after the BHW.
Anyone thinking of buying a camera take note.
I have the same issue with my gopro.. forget to clear the card and it's not working when you need it most..
Make sure you buy one that has loop recording and then you can forget about it...

Thanks Phill. I've seen quite a few cyclists riding around Central London with 2 very large hub motors in each wheel on a full suspension frame. Incredible warp-speed-like performance. Didn't spot a number plate, nor any form of registration. I guess it's up to the policeman's discretion if your ebike is still a bicycle or a moto-ped.

RE: The action camera. I bought my HD Drift Ghost S as it has the car DVR facility. It records continuously, and saves the data in the event of a knock, etc. The latest firmware has improved the video quality, but the GoPro has the best image quality.

But yes, boy do i regret not having wiped the card and recorded the accident. MicroSD cards are cheap. My 64 Gb Class 10 Transcend Premium MicroSD card was £32 off Amazon. I wish I'd bought 2 of them and swapped them round every other day.

From what you've said, the delay to date, and my knowledge of similar accidents, I'm sure you won't hear anything more.

The police are careful to make a check on each cycling accident involving any possible injury following the large spate of cyclist deaths over a year ago. There was also an accident where a London cyclist hit a 44 year old mother on 12th March. As a result she sadly died in hospital on 19th March but the cyclist has not been arrested.

Your accident is a rather small event in comparison.
