Who is Liable to Exceeding 15.5 mph on an E Bike

If it's the Rider (Which I agree) / Owner, then how can the motor manufacturer shut the motor down, with its software, if the bike exceeds 15.5 mph ??????
The Rider / Owner could say: off road use, let me loose!
I am lost...

It is the rider that gets the sharp end of the stick, as you say but in order for you to understand more, if I am remembering correctly, it was very simple for someone to derestrict the speed limit on the bike and so pressure was put on at least Bosch to make it harder for this to happen. Hence the restrictive software.
Whether this applies to other makes of bike motor I don't know. Someone will always find a workaround but then you will always suffer the legal consequences if caught.
If you live in a country that has no restrictions then I'm not sure what your options are regarding purchasing unrestricted mainstream models.

Anyone owning a de-restricted bike, and who is riding well above the 25KMH allowed, will be picked out easily by the eyes of the law.
To be safe, the rider must say within the legal speed limits, so what has he gained from his de-restricted bike's performance?
Basically nothing!
And at any point, the police can STILL require full testing, eve if he is NOT riding too fast!
I fail to understand the points of view shared by riders with an illegally tuned bike.....Unless of course it is fully registered, insured and road tax paid.....
And, Heaven forbid, he/she is involved in an accident, where another member of the public gets injured, even if they have insurance (I do, just in case I accidentally scratch a car or anything happens), the insurance could turn up their nose at paying out, if the bike is found to be illegal....
I am unsure of the way an insurance company might react in such circumstances.....
End of the story is, why take the chance?

Suffice to say, a liability insurance is really for ANY bike rider a damn good idea, and is not expensive!
Anyone here who rides uninsured???

I forget where it was but a few years ago, someone lost his house due to him having an accident on his e-bike, with a lady that was looking at her phone while crossing the road......This may have been the accident, he had to pay the court costs as he lost the case - DUUHHH!:-

The final outcome was far from the story in the independent, the guy I believe counter sued and it go a bit silly and both were found 50% culpable. In the end he did have to cough up money but don't think he lost his house, a funding page was set up and believe this paid for his share of the bill. The woman for her troubles got about 5k out of the claim.
