Who are Panda Leisure Bicycles? (Panda XL)

Dear all

Does anyone have experience of the Panda XL eBike, and/or know who are Panda Leisure Bicycles and how we can contact them?

We get multiple messages from customers of the Panda XL eBike wanting support, and because Panda Leisure appear to have no online presence or available phone number it is quite difficult to know what to say to these customers.

Not to mention the more concerning facts that this company was incorporated significantly after ours, and is in clear infringement of our Trademarked brand "Panda eBikes" under Class 12 goods and services for the UK and Europe.

Thanks - I found this on the company register also. But we already sent them letters and had no reply. Before we actually consider going after them formally with lawyers I would prefer to speak with them....

Make sure you're aware of the unjustified threats provisions of the trade marks act 1994 (section 21). Limit your accusations to the wording in that section or you could be placing yourself at risk of a counter claim.

Is your trade mark for the text alone or part of a figure as that will narrow the scope of protection it affords?

Also if Panda leisure bikes commenced use of the mark prior to your trademark registration then they enjoy a prior user right, but you could still try a "passing off" claim.
