That case... and the public interest

Good Evening all!

I'm in the middle of a debate with one of the cycling industry publishers and I think I'm right, but I'd quite like to be wrong (as there is good money to be made).

So here's my question, as I've spent 30 minutes searching on here and whilst I'm sure its been discussed I can't find it.

At some point in the past there has been a UK case where a UK eCyclist was going to be prosecuted, but the prosecution was dropped because it wasn't in the public interest.

Would this be recorded anywhere, does anyone know any details?

I have a sneaky feeling it might have been back when the UK law was 200w, but everyone was selling and riding 250w, and thats why it wasn't in the public interest to prosecute - because the law was always going to be changed.

The issue has come up because a certain distributor of eBikes has said:

"There has already been precedent set whereby a customers was hit by a public bus on a speed pedelec and the bus company tried to prosecute on grounds of no registration, tax or insurance, but the defendant was found not guilty because it was deemed not to be in the public interest to do so. I think in a legal context this could pave the way for anyone using a speed pedelec, so long as they do not cause public harm."

Now in all my time selling and working with eBikes and the law I've not come across this case. But its being used as justification for the selling of sPedelecs in the UK.

So are we at KTM and our dealers missing a trick? Is there a case that has set a precedent for this? I really can't see it.

Does anyone have any details of any cases at all either way on anything eBike related?

I'm not trying to start a debate on legality or anything. I'm just looking to see if anyone knows anything I don't about UK cases.

You okay Col? Have you had a bit of a knock on the head today? I'm afraid I can't help you with the info you are looking for, but it's nice to see you approaching this from the other end for a change. It'll be interesting to see how this thread develops.

Have you asked 50Cycles?
We have a great relationship with the people behind most brands of bicycle and eBike in the UK, but I don't know anyone at 50Cycles so I didn't think they'd reply.

Personally I have a suspicion that its made up, so I can't see 50Cycles admitting that to me in writing. So as there are plenty on here who will know the answer to this I wanted to see if anyone did, so I can continue my debate with the journalist with details of the case that I've heard about, because he doesn't appear to be able to produce any details of the case he's been told about.

ebike shop has no problem at all selling s class bikes and dongles so there s class anyway and no 1 has had there bike taken away.

its like how would the cps prove it as i can still power the bike my self after any cut off speed and as it has no throttle cant say stick it on a dyno as 1 person is fat and 1 could be fit and ride race bikes every day and thus be able to ride it with no power lot faster.

if bosch cant even prove a dongle has been used what hope does the cps have of getting a conviction ie none.

We only sponsor people who race between the tapes, or are responsible brand ambassadors, so I'm afraid currently your application for support has been declined :)

We'd suggest buying a motorbike or mountainbike and racing properly to experince some real adrenaline and challenge yourself.

tbh i cant find that case in the news or a few others where ppl have died like its been wiped of the interweb???

soon as the cps are not interested in prosecuting it just vanishes of the face of the earth.

ITS NOTHING TO DO WITH SPEED.

I'M ASKING IF ANYONE CAN FIND THE DETAILS OF THE CASE, BECAUSE ITS BEEN DISCUSSED ON HERE BEFORE.

MY COMPUTER ALSO HAS GOOGLE.... so please stop posting irrelevant things, I can find them too.
