Indeed, idiotic behaviour by that motorcyclist. It didn't matter what the cyclist was doing, he was stationary so there was no possible excuse for colliding with the bike.

It was just impatience.

Whilst I agree that the motorcyclist is in the wrong, the cyclist is also at fault - he isn't stationary, he's clearly moving slowly forward, and he shouldn't be on the phone whilst he's cycling, IMHO

My mistake then Phil, I thought he was stopped. However, although wrong, the phone made no difference, he doesn't have eyes in the back of his head to see what was going to happen so no amount of attention would have stopped him being hit.

As someone once said, on a bicycle the danger generally comes from what's behind, on a motorbike it generally comes from what's in front.

I agree as to the cause Flecc, as I said, but it's still foolish to be using your phone whilst cycling, as it is whilst driving I wonder if it contravenes any law too?

As a biker myself - the ducati rider seems caught up in 'city rush' and dives into a non-existant gap. Though not sure what the status of the darker lane is between opposing lanes (is it really a cycle lane? if so then what's the biker doing on it... )

Cyclist doesn't do himself any favours being on the phone while in motion but probably would have been clobbered even if he wasn't nattering away, but again he might have stood a chance of hearing the throb of the duke coming up his six and done something different.

I agree Phil. There are some behavioural laws on cycling which are a bit catch-all, so no doubt one of those could be used.

For example, inconsiderate cycling is covered by the Road Traffic Act 1988 sections 24, 26, 28 & 30, as amended by the RTA 1991 section 7.

And using a phone while riding surely is inconsiderate.
