Knocked off my bike this morning- Write off?? Advice?? Fault??

You can GUARANTEE that she is already telling everyone that she does not know what the fuss is about.....

Good advice from d8veh.

I have only skimmed through this thread. Did you exchange details? Did she give you her Name, address and insurance details? This fits the definition of an accident where the driver of a motor vehicle has a duty to provide this information to any person entitled to ask for it (you). If they don't, then they must report the accident at a police station within 24 hours and if they don't, they will commit an offence of, "failing to stop" for which the penalty is.......well, probably nothing much at all really. But she should do and the station Inspector will be jolly angry if she doesn't.

I did not go into details in case I frightened you, but as some time has passed and you are OK, I will.
When you have been in an accident such as this, you have no idea if you are injured. Serious injuries do not hurt because the body releases endomorphins to numb the site of the injury.
Standing up before you are sure you do not have any fracture is not a wise idea.
You seem to have been hit quite hard, and there is nothing reprehensible about staying on the ground until a paramedic etc. gives you the OK.

Ok everyone.
Firstly thanks a million for all the kind words and sage advice.
Secondly, I have been in touch with my GP as pain in my ankles and wrists was beginning to develop, as well as a sore back. She tells me that there is nothing to worry about; just to rest up, and she also prescribed Ibruprofen.
Thirdly, I have been in touch with my solicitor, who is willing to put in a personal injury claim, as well as sort out any repairs/replacement of bike.
I still worry that the bike will be repaired, case settled etc, only to find out that something is wrong inside, or the frame is weakened etc...
I will instruct my solictor to try and reclaim the full amount for a replacement, and hopefully he will be successful.

Again thanks, and I WILL keep all updated.

One further bit of advice-keep a diary of events,for sure the lady won't and time eradicates the times/details-keep records of all phone conversations-you will make life so much easier for your solicitor if you have everything in chronological order. Insurers will wriggle at some stage,the lady will have a completely different memory of events and such a well organised claim will reduce insurer's wriggle room and make the claim less stressful for you.

Sorry to hear of your accident Pinbin and glad you are still in the land of the living . The Woman is fortunate not to be facing a serious charge of killing someone and ought to appreciate that in any future dealings . As Dave has said document everything , especially any of her silly quotes , sketch out the location for the Insurance , with distances and pictures .When your bruises or grazes come out , take pictures . Alloy does not take kindly to bumps and stresses , especially in cold weather and with Labour rates of £40-£60 an hour . it won`t take much to achieve a write-off .

dont really get why you have not contacted the police...a simple phone call that is all

Also does "been in touch with GP" mean that you did not visit them? as this is not good either.......

Hope your ok and get it all sorted, I had something similar happen to me 18 months back or so although I was on a motorbike at the time. i might repeat a few items others have said but I personally don't think it these can be repeated too often.

1 report it to the police - they will probably just wipe there hands of it but at least your covered and you have a id number to put on any claim.
2 I would say you want your bike replacing my motorbike was written off due to a buckled wheels and frame and to be honest would you trust getting bak onto it?? That could be an important factor it might just not feel right to you??
3. keep a diary include all the little things - could not load dishwasher, had to get someone to lift a paper box at work etc. (these you will forget in 6 weeks time when you are send for an assessment)
4. photograph the scene, refresh yourself of your position draw it all out ready, were the street lights on, what lights did you have on, photo your clothing (assuming your not one of the black huddle no lights group)
5. Be prepared for a fight in my rear end bump I was accused of rolling back, this I guess might be the standard insurance argument. Don't forget an ebike does have a reverse gear just like a motorbike ;o)

I am not sure but you might be able to hire a bike and claim it back?

Ok, Eddie my dear, I called the police on 101 first thing. I then went to the local police station to fill out a form and statement. This will be submitted tomorrow AM together with the medical report.
I don't see what the police has to do with the damage to my bike- generally the police will not come out unless there has been an injury. If you read my initial posts; you will see that at the time of the accident, I had no obvious pain or injuries.
As for the blond business, I don't even know her hair colour- I was too shaken to check.
But I bet if I would have it would have been....... :)

Also, regarding the GP- I visited her of course. I'm not sure why you're being so snarky about it all- it wasn't your missus by any chance was it???

Very sorry to hear about your accident Pinbin, and glad you appear to have been v.lucky and not badly injured bearing in mind the circumstances.
I see you've been given lots of advice so I'll stick with the trend by suggesting you should get yourself checked out at you local A&E outside your GPs surgery hours and make sure you tell them your injuries were the result of an RTA. If you can put up with the waiting times its worth getting properly checked over and if necessary precautionary x-rays. This visit will also help with any subsequent injury claim your solicitor submits to the third party's insurers.
You will be entitled to claim for a replacement bike for a reasonable period whilst you wait for yours to be assessed for repair or written-off (indeed for any out of pocket expenses you otherwise wouldn't have paid out if it wasn't for their careless driver..keep all receipts). However as somebody has already pointed out you are expected to mitigate your losses, so no weekend 5-star retreats to recuperate..!

Glad you are OK, it must be that time of year, I've had 3 near Misses in the last 7 days, all overtaking on right hand turn related in quiet streets, starting to wonder what I have to do it be seen on the road.

I already have a high vis waistcoat, high vis hump rucksack cover, high vis wristbands, 2 Bright rear LED lights, 1 flashing, 1 steady, FOUR nite ize spoke lites in flashing mode, 2 800 lumen handlebar mounted front lights and a 1000 lumen head mounted light (turned right down when on rd so not to dazzle). Out in the country there are reports of UFO's whenever I go by, but in Farnborough, at rush hour I may as well have Harry Potters cloak of invisibility on.

Not in the least bit narky? just concerned that you cover yourself for all eventualities. Anyway, like any forum thread others are watching and hopefully taking on the what is the best course of action under similar circumstances...

You will need a police incident report for either a claim on bike or a personal injury. You have been advised on here by at least 4 people that it can take days for problems to start exhibiting themselves...I know this from personal experience.

IF it had been my wife (brunette) I doubt you would be here discussing the matter...she is a terrible driver, the worse thing I ever bought her was bluetooth:confused:

Hi Pinbin - you have got a lot of good advice here. As a former personal injury lawyer, I would just add that if you have any doubts on the bike claim for a new one - it's pretty small change for insurance company. Keep all receipts of anything you may have had to pay for as a result of the accident (taxis, rental of a bike, replacement of damaged clothing?). It might take a long while but you will get the money back eventually. Despite what others have said I do not think you will have any difficulties on liability - it will seem a pretty open and shut case to anyone who looks at it (although an independent witness is always a good thing to have (for future reference) - if there is anyone around).
