You haven't assessed its performance, reliability and durability yet. You might be doing it again pretty soon!

lol, you could be right there. so i have charged it but am not happy with the result. only showing 38.8v. i wonder if thats because some cells were already charges. so i'm goning to run it for a while and see if i semi flatter it, if it charges better next time.

You have to balance the cells manually before you start using the battery. The BMS only does about 100mA for a few minutes, so it has no chance to deal with big discrepancies like you have at the moment

In order for it not to charge, one cell needs to be at 4.2v or above, or one cell needs to be below 3v. Your problem must be somewhere else. If you want to balance the 10th cell, use a 6v light bulb ton drain it down. A 5w one should be about right.
Generally can't disagree with what you have said at all.

Though I do have a 7s charger which will not allow any charging what so ever if over 39 v, I can only assume it sees a near full battery. Once the battery has been discharged a little more it switches on and allows charging .

so can i not balance the cells by running the battery down slowly through a motor and then recharge. the motor should draw enough power to do this, or am i wrong. i tried draining the high cells last night but every time i did they recharged of the other cells.
