Whilst agreeing with your last line, these are not quite the same things. In fairness they do often refer to driver, motorcyclist, even pedestrian in such negative sentences. It's often just shorthand to express a few details compactly.

Could be inaccurate of course, did anyone actually see him riding the bike? It seems he just walked on board pushing the bike, making him a pedestrian in law.
