Please note that if you wish to exercise your right to return goods under these provisions items must be NEW and UNUSED in order to receive a full refund. The retail sales value of a used item is generally 60% of the new and unused value. THIS APPLIES EVEN IF A BIKE HAS BEEN RIDDEN ONLY ONCE. Please therefore ensure that the item has not been used at all unless you are likely to receive only 60% of what you paid for it when new. Please USE A BOX and proper packing materials. Items damaged due to careless packaging will not be refunded. Sales of items specially ordered, including specially ordered sizes, or customised to customers requirements are final & may not be returned.

Thats seems to conflict the law unless im reading it wrong :

Distance selling
You must provide certain information if you’re selling goods or services through digital TV, by mail order or by phone or text message. This is called distance selling.

If you don’t follow the rules you could be made to provide the goods or services as agreed, pay compensation or be given an unlimited fine or a prison sentence.

"You could be made to provide the goods or services as agreed"

Surely that means supplying the right size bike for the end user and not hammering 40% out of them especially when you as the seller guarantee the fit of the frame.

any bike in this price range will be ok with ur waight with giant it is there own batts and lcd so only there stuff will work with it where as other Yamaha motors and parts are standard thus less hassle if you say brake the display in a crash.

dongles are also a pita and limited options and about 140 quid depending on motor.

Oh no, now what about the giant? Uses the pw-x motor and good price. But not sure what weight it takes

Im in the market for an ebike and this was on my short list
I went to look at one but for me the horizontal top tube length was a bit short in the seat tube length i wanted for standover height
It rode we'll enough just felt a little cramped in the cock pit
If anything i found it a bit to eager on the up take on power delivery and felt compared to the bosch it could be a bit aggressive in an off-road scenario on a slippery slope for example .

This is in stock at my local dealer. Can I be a pita and ask what's better about it than the other giant one I linked to?

you can sit on the bike to check if it fits, you don't need to take it to Hadleigh Olympic Bike Park to see if the handlebars are wide enough and return a bike with a damaged rim or damaged tyre or in need of cleaning for a full refund. I exaggerated there but as long as the customer is forewarned what will be accepted and what's not, the vendor can insist that the goods be returned unused for a full refund. This is not illegal.
One point about guarantee: it covers manufacturing defects and poor workmanship. It usually does not cover anything touching the ground, professional or sport activity. if your handlebars break when you go down a steep run, you are not covered.

You can’t just sit on a bike to see if it’s comfortable and fits well
I’m not saying go for a trail ride but a quick whizz around on a clean dry pavement should be fine if you want to sell on the net and guarantee it will be fine
Tell me do you buy shoes and not stand up and have a quick walk around before buying them to see if they fit or do you just sit there with your feet off the floor and buy them :)

that's beside the point, which is it is not illegal to require the unwanted item be returned unused if you want a full refund. You can't for example open a bottle of wine and send it back for a full refund.
The only requirement for it to be contractual is that the information must be communicated to the customer before going through with delivery.

Your just being daft now with the wine
We are taking about a high value item that could potentially not fit

That seller has said he will guarantee the bike fits and will be a perfect size
So if it’s not is that the purchasers fault ?

what's wrong with sitting on the bike? if it does not feel right, shouldn't you contact support instead of taking it out, clocking up 5 miles and then decide it does not fit or you don't like it and it should become someone else's problem?
Lots of suppliers are more flexible than the company where that extract came from but we are debating the legal point here aren't we?

If you have to ask what’s wrong with sitting on a bike for size without turning a wheel your in the wrong game
I’m not saying you should put 5 miles on it that’s just crazy I’m talking about a quick spin round a car park or something which is no more than any decent bike shop would do for a pdi
I can’t continue with this as your on one side of the fence and I’m on the other so we’re going to have to leave it there
What I will finish with thou as I’ve test road a few bikes round the car park from a few different dealers and not been charged over a grand for the pleasure :)
