Batteries of any type are definitely regarded as consumables, and many product warranties and manuals say as much.
It's a loophole that does have ill effects on consumers, the most blatant example being the part empty ink jet cartridges that are fitted to new ink jet printers, making them only fit for purpose for a very short period.
I understand the warranty on the eZee batteries is 6 months, but on the Kalkhoff-Panasonic battery, 2 years.
