can bosch prove a dongle has been used

nope and thats proof from Bosch them self so any retailer refusing warranty for using one take them to court as will not be able to provide proof that 1 has been used on a bike or not in any court of law.

retailers like ebike shop will offer warranty wonder why lol.

When the Bosch diagnostic reader finds built in log records showing a relatively low milage and an associated increase in charge cycles compared to normal it won't be hard to figure out that something's been fiddled with...

Doesent prove anything.Maybe I have lots of very steep hills and use turbo only.And then I use the bike unassisted everywhere else for example

So the way that reads , any dealer fitting dongles is going against there contract with bosch
The code of practice is what Bosch is trying to achieve and it will tie dealers to its rules if introduced.

The dongle maker has only created a hardware fix it does not have full access to the software system, if it did then the fix could be done without any new hardware. I doubt if any Dealer or OEM have full access to the Bosch software system.

I'm totally against the dongle's , I'm a firm believer that it's only doing harm to the ebike reputation and obviously the law side of thing's come into play as well , each to there own thou
